PRIVACY POLICY
OF THE
ROTARY CLUB OF OMAHA-WEST
 
The members of the Rotary Club of Omaha-West, Inc. d/b/a Omaha West Rotary ("Rotary" or "we") respect your privacy and are committed to protecting it through our compliance with this privacy policy ("Policy"). Maintaining protection of the data entrusted to our care by our constituents is of the utmost importance.
This Policy describes the types of data we may collect from you or that you may provide and describes our policies and practices for collecting, using, protecting, and disclosing that data.  This includes information collected in the process of using mobile applications, desktop applications, email,  SMS,  text messages or other electronic messages sent between you and our system.
1.         Types of Data We Collect
Omaha West Rotary will receive the following information from our third party service provider: your mobile phone number when you send a text message to us, the text of messages that you send to other users of the Service, any user or screen name that you select in connection with the Service, as well as any comments or feedback regarding the Service that you send to us.
The information we collect through the services we provide may also include:
(a)        Creating an account and accessing our Services using a user name and password;
(b)       Donating, which may include full name, home address, billing address, payment type, and credit card details, as applicable, to ensure secure, non-fraudulent transactions;
(c)        Registering for any event or group;
(d)       Signing up for newsletters or other information sources;
(e)        Taking quizzes or playing games; and,
(f)        Signing up to receive SMS text messages.
2.         Why We Collect Your Personal Information
We use Personal Information to do the following:
(a) provide you with the SMS service;
(b) process and respond to inquiries;
(c) improve the SMS messaging system;
(d) if necessary, contact you with important announcements or messages; and
(e) conduct research about the club’s activities.
Each message that you send through our system may be stored on our servers. We retain may retain these messages on our servers and those of third parties who maintain our servers and services. Omaha West Rotary utilizes servers and services owned by third parties.
3.         How Long We Retain Your Personal Information
To preserve Omaha West Rotary's history and legacy, we gather historical and archival information about our club, which may also include limited personal data of its members.  Omaha West Rotary retains your personal data for as long as necessary in the circumstances, specifically including the following:
(a)        As long you are a member of a club or have a relationship with our network
(b)       For a reasonable period to send you donation information, program information, and marketing materials where we have regular contact with you, or
(c)        As may be needed to enforce or defend contract claims or as is required by applicable law.
(d)       Until you opt out of the system.
(e)        You request that your data be removed.
4.         Disclosure of Your Personal Information
Omaha West Rotary will not rent or sell your Personal Information to anyone.  We will not use or disclose your Personal Information except in the following limited circumstances:
            (a)        We have your permission;
            (b)       We need to enforce our Terms of Service;
            (c)        We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights, or the legal rights of others, or defend against legal claims.
(d)       We believe it is necessary to share Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law.
(e)        We provide such information to trusted businesses or persons for the sole purpose of processing Personal Information on our behalf. When this is done, it is subject to agreements that oblige those parties to process such information only on our instructions and in compliance with this Policy and appropriate confidentiality and security measures.  If the third party fails to comply with our terms, we are not accountable in any way for any liability or reimbursement.
(f)  If disclosure is necessary or appropriate to protect the rights, property, or safety of Omaha West Rotary, Rotarians, Rotary clubs, Rotary districts, or others. This includes exchanging personal data with other companies and organizations for the purposes of fraud protection and credit risk reduction.
5.         Consumer Rights Regarding Your Personal Data
Omaha West Rotary’s third-party service provider gives you the ability to opt out of the messaging system for any reason. You can opt out by texting “STOP” or “QUIT”.  You may also contact us and tell us you wish to opt out of the system.
We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.
You have the right to have your personal information removed from our system upon request. You can request to see or delete your personal data. You can sign into your account to see or delete any personally identifiable information we have stored, such as your name, address, email or phone number. You can also contact us by email to request to see or delete this information.
Your rights as listed in this section do not limit any other rights you may have according to any agreements or laws not specifically included in this policy.
6.         Associated Costs Warning
There may be some costs associated with Omaha West Rotary sending or receiving wireless text messages or other types of messages.  Omaha West Rotary is not responsible for any costs associated with the use of its messaging services.
7.         Limitation of Liability
We and the third-party providers we use will implement reasonable technical and operational measures designed to secure your personal data from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our services.
8.         Other Terms and Conditions
Omaha West Rotary may change, add, modify or remove portions of this Policy at any time, which shall become effective immediately upon posting on this page.
Our  SMS system is not intended for children under 16 years. We do not knowingly collect personal data from children under 19 without parental consent. No one under age 19 may provide any personal data to or on our services without written permission from a parent or guardian.
